establishes Council's requirements for Exempt and Complying Development. Exempt Development is minor development having minimal environmental impact (such as small fences, garden sheds, barbecues, pergolas and TV antennas etc) as listed in Section 2.2 of the Plan. Exempt Development does not require a development consent to be obtained if certain criteria are met. Complying Development is small scale, low impact, routine development that is clearly defined in Section 3.4 of the Plan. Complying Development is defined by reference to the fixed development standards listed. These development standards are non-discretionary, enabling a "non-merit" assessment. If the proposal does not satisfy the development standards it is not classed as Complying Development and cannot be approved as such. In these cases either a Development Application would need to be lodged with Council, or the proposal modified so as to meet the Complying Development standards. Conditions of consent cannot be imposed on a Complying Development Certificate requiring amendment of the proposal so as to render it Complying Development.
